Section 1

Acceptance of Terms

By accessing or using BOB ("the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the Service. If you do not agree to these Terms, you may not access or use the Service.

You must be at least 18 years of age to use the Service. By using BOB, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement.

We reserve the right to modify these Terms at any time. Continued use of the Service after any modification constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify users of material changes.

Section 2

Description of Service

BOB is an AI-powered workday analysis platform. The Service allows users to upload screen recordings of their workday, which are then processed by artificial intelligence to generate insights about productivity patterns, time allocation, and workflow inefficiencies.

The analysis is powered by Google's Gemini API, a third-party AI service. BOB acts as an intermediary between you and this AI system, formatting your recording for analysis and presenting the results in a structured report.

Features of the Service may include, but are not limited to: waste pattern identification, automation opportunity recommendations, time breakdown analysis, and shareable productivity reports. Features are subject to change at our discretion.

Section 3

Your Content

You retain full ownership of all screen recordings and other content you upload to the Service ("Your Content"). These Terms do not transfer any intellectual property rights in Your Content to us.

By uploading content to the Service, you grant BOB a limited, non-exclusive, royalty-free, worldwide license to process, transmit, and analyze Your Content solely for the purpose of providing the Service to you. This license terminates when your content is deleted from our systems in accordance with our data retention practices.

You are solely responsible for Your Content and the consequences of uploading it. You represent and warrant that: (a) you own Your Content or have the necessary rights, licenses, and permissions to upload it; (b) Your Content does not violate the privacy, publicity, intellectual property, or other rights of any third party; and (c) uploading Your Content does not violate any applicable law or regulation, including any applicable employment agreements or confidentiality obligations.

We strongly recommend reviewing your screen recordings before uploading to ensure they do not contain sensitive personal information, passwords, financial account details, confidential business information, or private information belonging to colleagues or third parties who have not consented to this analysis.

Section 4

AI Analysis Disclaimer

The analysis, recommendations, and insights generated by BOB are produced by artificial intelligence and are provided for informational and productivity-improvement purposes only. They do not constitute professional advice of any kind, including but not limited to legal, financial, medical, HR, or business consulting advice.

AI-generated results may be inaccurate, incomplete, or contextually inappropriate. The Service analyzes observable on-screen behavior only and cannot account for the full complexity of your work context, role requirements, or organizational constraints.

You should not rely solely on BOB's analysis for any important business, employment, or personal decision. Always apply your own professional judgment when interpreting and acting on the results. BOB expressly disclaims any liability for decisions made in reliance on AI-generated analysis.

Section 5

Third-Party Services

The Service relies on Google's Gemini API to perform AI analysis of your recordings. By using BOB, you acknowledge that your content will be transmitted to Google's servers for processing. Google's use of your data is governed by Google's Terms of Service and Privacy Policy, which you should review independently.

Payment processing is handled by Stripe, Inc. Your payment information is transmitted directly to Stripe and is governed by Stripe's privacy policy and terms of service. BOB does not store your full payment card details.

We are not responsible for the practices, policies, or performance of any third-party services. We make no representations or warranties regarding such services and disclaim all liability arising from your use of them.

Section 6

Prohibited Uses

You agree not to use the Service to:

• Upload recordings of individuals who have not consented to being recorded, where such consent is required by applicable law
• Upload content that violates any applicable law, regulation, or the rights of any third party
• Upload content containing material that is obscene, defamatory, threatening, or harassing
• Attempt to reverse-engineer, decompile, or extract the underlying AI models or algorithms used by the Service
• Use automated means to access or scrape the Service without our prior written consent
• Resell, sublicense, or otherwise commercialize the Service or its outputs without our express written permission
• Attempt to circumvent any security, access controls, or usage limitations of the Service
• Use the Service in any manner that could damage, disable, or impair the Service or its servers

Section 7

Intellectual Property

The Service, including its software, design, user interface, brand identity, pattern library, and all associated technology, is owned by or licensed to BOB and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written consent.

The analysis reports generated by the Service are provided to you for your personal or internal business use. You may share reports for personal or non-commercial purposes. Commercial use of report content requires our prior written consent.

Section 8

Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT AI ANALYSIS WILL BE ACCURATE OR COMPLETE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL BOB, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS (USD $100).

Section 9

Indemnification

You agree to defend, indemnify, and hold harmless BOB and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

Section 10

Governing Law

These Terms and any dispute arising out of or related to the Service will be governed by and construed in accordance with the laws of the State of Rhode Island, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Rhode Island, and you hereby consent to the personal jurisdiction and venue in such courts.
